The California Supreme Court ruled yesterday that both members of a lesbian couple who plan for and raise a child born to either of them should be considered the child's mothers even after their relationship ends.

This would be a no brainer if this couple were heterosexual.
The advancement of IVF and infertile hetero couple issues were settled in courts when couples used non family surrogates to bear or donate half of the genetic material for the babies. These are the family situations gay parents resemble. Foster and adoptive MARRIED hetero couples who break up are required to maintain parental responsibility.
It's the fact that gay couples are NOT married that brought this case into the courts and it's a cart before the horse situation, which is unique to gay couples. Had these women been legally married, the issue would have been settled like it is for other married couples with one biological or two adoptive parents. Sometimes I really wanna go DUH, to those opposed to marriage equality get involved. They lose their moral objections because no heterosexual is qualified to marry based on morals.
And the opposition loses their support of children as reason for denying gay parents the option to marry to protect THEIR kids...whether they stay together or not.
This is a victory for the children of these parents. Period. And should be a lesson to those who want to ban marriage between gay parents. Punishing the children of gay people to get at the parents is patently stupid and cruel and belies any entreaty that their opposition to gay parents is for the 'protection' of any children.
